Shared XP Terms of Service

1. Acceptance of these terms
These Terms of Service ("Terms") govern your use of our EmptyEpsilon-based bridge simulator services, including online sessions, our personnel/profile system, and in-person events (together, the "Service"), provided by Artianic Ltd, trading as Shared XP.
By creating an account, joining a session, or attending an event, you agree to these Terms. If you do not agree, please do not use the Service.
Our handling of personal data is covered separately in our Privacy Policy, which forms part of your agreement with us.
2. Eligibility
The Service is intended for users aged 18 and over. By using the Service, you confirm that you meet this requirement.
Minors may attend in-person events only when accompanied by a parent or guardian, who remains responsible for them throughout the event.
3. Accounts
Access to the Service is provided via Discord authentication. You are responsible for maintaining the security of your Discord account and for all activity that occurs under your account on our Service.
You may not share your account or impersonate another person. Each user should hold one account.
We reserve the right to suspend or remove access to any account that violates these Terms.
4. Acceptable use
When using the Service, you agree not to:
- Harass, threaten, or abuse other users, game masters, or staff
- Disrupt sessions, whether online or in person
- Attempt to bypass, exploit, or abuse game-master or admin tools and permissions
- Use the Service to share unlawful, hateful, or sexually explicit content
- Misuse another user's personal data obtained through the Service
Breach of this section may result in suspension or termination of access, at our discretion.
5. User-submitted content
You may submit content as part of using the Service, including your callsign, profile bio, uploaded photo, and in-universe writing or character material ("Your Content").
You retain ownership of Your Content. By submitting it, you grant Shared XP a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and adapt Your Content for the purposes of operating, promoting, and developing the Service (for example, displaying it on our personnel database, website, or printed session materials).
You confirm that you have the right to submit Your Content, and that it does not infringe the rights of any third party.
We may remove or edit Your Content at our discretion, particularly where it breaches Section 4 (Acceptable use).
6. Game-master and admin authority
Game masters and admins are responsible for running sessions and maintaining the integrity of the Service. They may:
- Moderate conduct during sessions, online or in person
- Edit, correct, or remove personnel and mission records
- Remove a user from a session or revoke access to the Service for breach of these Terms
7. In-person events
We plan to run sessions at physical venues. When attending an in-person event, you agree to:
- Follow venue rules and reasonable instructions from staff or organisers
- Behave in a manner that does not endanger or harass other attendees
- Take responsibility for your own personal property
Shared XP is not liable for loss, damage, or injury arising from attendance at an in-person event, except where caused by our negligence, and to the extent permitted by law.
8. Service availability
We do not guarantee that the Service will be available at all times, or that sessions will run as scheduled. Sessions may be delayed, rescheduled, or cancelled at our discretion.
We may modify, suspend, or discontinue any part of the Service at any time.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we reasonably believe your conduct poses a risk to other users or the Service.
You may stop using the Service, or request deletion of your account, at any time by contacting us.
10. Liability
The Service is provided on a community/hobby basis. To the extent permitted by law, Shared XP is not liable for any indirect, incidental, or consequential loss arising from your use of the Service.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under UK law.
11. Governing law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to these terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Significant changes will be communicated via our Discord server.
